Refund Policy

At ApexMetricDynamics, we are committed to delivering high-quality business automation services. This Refund Policy outlines the conditions under which refunds may be issued.
1. Service Delivery
All services are delivered as described in the project proposal or statement of work provided to you prior to commencement. Payment milestones are tied to specific deliverables. Refund requests are evaluated based on the stage of project completion at the time of the request.
2. Eligibility for Refund
Refunds may be issued in the following circumstances: if work has not yet commenced on a paid milestone; if we are unable to deliver the agreed-upon service due to circumstances within our control; or if a duplicate payment has been made in error. Refund requests must be submitted within 14 days of the relevant payment.
3. Non-Refundable Items
Services that have been fully delivered and accepted are non-refundable. Work completed under approved milestones that have been signed off by the client is considered final. Consultation fees, research fees, and third-party licensing costs are non-refundable once incurred.
4. Process

We will review your request within 5 business days and respond with a resolution. Approved refunds will be processed to the original payment method within 10 business days.
5. Disputes
If you are dissatisfied with our refund decision, you may escalate the matter by contacting us again with additional details. We are committed to resolving disputes amicably and in accordance with applicable Spanish consumer protection laws.
Terms of Service

By accessing or using the website and services of ApexMetricDynamics ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
1. Services
ApexMetricDynamics provides business automation services including workflow engine development, API integration, document processing, analytics, scheduled automation, approval pipelines, data migration, and custom bot development. The scope, timeline, and pricing for each project are defined in a separate proposal or statement of work agreed upon by both parties.
2. Client Obligations
The client is responsible for providing timely access to necessary systems, data, and personnel required for project execution. Delays in client-provided resources may impact project timelines. The client warrants that they have the legal authority to provide any data or system access required for the engagement.
3. Payment Terms
Payment terms are specified in each project proposal. Invoices are payable within 14 days of issuance unless otherwise agreed. Late payments may incur a 1.5% monthly interest charge. All prices are in Euros (€) and exclusive of applicable taxes unless stated otherwise.
4. Intellectual Property
Upon full payment, the client receives full ownership of all custom code, configurations, and deliverables produced specifically for their project. ApexMetricDynamics retains ownership of pre-existing frameworks, libraries, and methodologies used in the delivery process. Both parties retain the right to reference the engagement in marketing materials unless otherwise agreed in writing.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information exchanged during the engagement. This obligation survives the termination of the agreement for a period of 3 years. Neither party shall disclose confidential information to third parties without prior written consent.
6. Limitation of Liability
To the maximum extent permitted by law, ApexMetricDynamics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total liability for any claim shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
7. Termination
Either party may terminate the agreement with 14 days written notice. Upon termination, the client shall pay for all work completed up to the date of termination. Completed deliverables and associated data shall be transferred to the client within 10 business days of final payment.
8. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Las Palmas de Gran Canaria, España.
9. Amendments
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated to existing clients via email at least 14 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
